Title Article 12 Proceeding for the registration of new articles in the Register of Parties

12

(1) The party may adopt new articles which shall contain a resolution on the cancellation of the registered articles, indicating the registration number and date of the party, including all dates and sequence numbers of the changed articles entered in the Register of Parties.
(2) The statutory body shall be obliged to submit to the Ministry an application for the registration of the new articles in the Register of Parties within 15 days from their approval. The following shall be enclosed to the application:
a) the resolution of the party body that is competent according to the registered articles to approve new articles, signed by the statutory body or the required number of statutory body members for taking such decision according to the articles; the signatures shall be certified; and
b) two copies of the new articles.
(3) If the application and enclosed documents are in compliance with this Act, the Ministry shall send one copy of the articles to the statutory body bearing the registration date and number of the party, along with the date of entry of the new articles in the Register of Parties with the
addendum "new articles". The new articles shall become registered articles as of the day of their entry in the Register of Parties. No decision shall be issued; it will only be marked in the file.
(4) If the application and enclosed documents are not in compliance with this Act, the Ministry shall send a written notification to the statutory body within 15 days from the commencement of proceedings to remove the deficiencies. If the party fails to remedy the deficiencies within the
specified time, the Ministry shall terminate the proceedings. No decision on the termination of proceedings shall be issued; it will only be marked in the file.
(5) If the new articles are not in accordance with § 6, section 5, § 7, section 9, letter d) or §7 section 9, letter e), the Ministry shall refuse to register the new articles in the Register of Parties and it shall file a motion with the General Prosecutor7 for an action according to § 17. The decision refusing the registration of new statutes shall be personally delivered to the statutory body. This decision may not be appealed, but it may be reviewed by the Supreme Court.
