Part Section Four - Reimbursement of Costs and Expenses for Election Campaigns
Title Article 18 - Principles and Extent of Reimbursement

18

(1) The costs and expenses that have to be made to ensure an adequate election campaign shall be reimbursed to the parties nominating their own candidates for Bundestag election. The expenses made for the election campaign shall be calculated at DM 2.50 for each person having the right to vote in such Bundestag elections as a total amount (global amount of the costs and expenses for the election campaign).
(2) The global amount of expenses for election campaigns shall be distributed between the parties which according to the final results of the elections have received at least
1. 2,5 per cent of the valid proportional votes submitted in the electoral area, or
2. 10 per cent of the valid majority votes submitted in the electoral district, unless a provincial ballot of such party has been admitted in the respective province.
(3) The share of the global amount of costs and expenses for election campaigns (reimbursable amount) shall be calculated as follows:
1. for parties under para 2, item 1 according to the proportion of proportional votes received in the electoral area,
2. for parties under para 2, item 2 - to the amount of DM 2,50 for each majority vote in the electoral districts where a minimum of 10 per cent of the votes has been received.
(4) The reimbursable amounts due to the parties under para 3, item 2 shall be deducted from the global amount of the costs and expenses for election campaigns prior to determining the amount to be reimbursed to the parties under para 3, item 1.
