32

(1) Where a party or a party organization is declared to be unconstitutional pursuant to Art. 21, para. 2 of the Constitution, the relevant authorities appointed by a federal province government adopt within the framework of the laws any measures needed to carry out the court ruling and any additional execution procedures ordered by the Federal Constitutional Court. To this end, the supreme authorities of the federal province shall have unlimited powers to issue mandatory instructions to such authorities and agencies of the federal province as are responsible for maintaining public security or order.
(2) Where the organization or activities of the party or that fraction of the party declared to be unconstitutional extend beyond the territorial borders of a federal province, the Federal Minister of Interior shall issue the necessary orders for uniform implementation.
(3) Pursuant to Art. 35 of the Federal Constitutional Court Act, the latter may carry out the execution of a judgement in a different manner to that prescribed in paras. 1 and 2.
(4) Neither objections to a writ of execution nor an action to set it aside shall have any suspending effect. Where administrative proceedings pertain to a matter which is of basic importance for the execution of a court ruling, the proceedings shall be discontinued and a decision of the Federal Constitutional Court obtained. The Federal Constitutional Court shall also decide upon any objections to the manner in which the executory measures it has ordered are carried out.
(5) Upon any seizure of assets, Arts. 10 to 13 of the Associations Act (Vereinsgesetz), of 5 August 1964 (Federal Legislative Bulletin, Part I, p. 593) shall be applied mutatis mutandis. The authority competent for the implementation of the ban shall be the supreme official authority of the federal province; in the case of para. 2, this shall be the Federal Minister of Interior.
