Title Article 33 - Banning of Substitute Organizations
Article

33

(1) It is prohibited to set up organizations which pursue the unconstitutional aims of a party banned pursuant to Art. 21, para. 2 of the Constitution in conjunction with Art. 46 of the Federal Constitutional Court Act instead of the said banned party (substitute organizations), or to continue the activities of organizations as substitute organizations.
(2) Where the substitute organization is a party which already existed prior to the ban on the original party or where it is represented in the Bundestag or a Landtag, the Federal Constitutional Court shall pass a declaratory judgement that it is a banned substitute organization; Arts. 38, 41, 43, 44 and 46, Para. 3 of the Federal Constitutional Court Act and Art. 32 of the present Act shall apply mutatis mutandis.
(3) Art. 8, Para. 2 of the Associations Act shall be applied mutatis mutandis to other parties and organizations which, within the meaning of Art. 2 of that act, constitute substitute organizations of a banned party.
