Chapter Paragraph 5. Cancellation of the subsidy in case of discrimination

16

1. Where a political party, on the basis of articles 137c, d, e, f, or g, or article 429 (4) of the Dutch Criminal Code, is sentenced to pay a monetary fine, the entitlement to a subsidy shall be cancelled ipso iure for a period starting on the day when the conviction becomes irrevocable. This period is:
a. one year, if the monetary fine is less than f 2.500,-;
b. two years, if the monetary fine is f 2.500, - or more, but less than f 5,000, -;
c. three years, if the monetary fine is f 5,000, - or more, but less than f 7.500, -; and
d. four years, if the pecuniary fine is f 7.500, - or more.
2. In the event that, on the basis of the Electoral law, no seats are assigned to the list of a political party on the day when the conviction becomes irrevocable, but one or more seats are assigned on the basis of an election taking place within a period of two years subsequent to that day, the period during which the political party is ineligible for a subsidy, is counted as beginning on the day of the election.
