One. The State shall issue to those political parties as are represented in the Congreso de los Diputados (Congress of Deputies) in accordance with Organic Law 5/1985 of the Régimen Electoral General (General Electoral Regime) and on an unconditional basis, annual grants, accounted for under the Presupuestos Generales del Estado (State Budget), to meet their ordinary operating expenses.
Two. These grants are to be distributed according to the number of seats and votes obtained by each political party in the most recent elections to the indicated Chamber.
For the purposes of allocating these grants, the corresponding budgetary allocation is to be divided into three equal amounts. One amount is to be distributed in proportion to the number of seats won by each political party in the most recent elections to the Congreso de los Diputados (Congress of Deputies), while the remaining two amounts are to be distributed in proportion to the votes obtained by each party in said elections. Votes in constituencies where the threshold of 3 percent of valid votes, as required under article 163, 1, a) of Organic Law 5/1985 of 19 June of the Régimen Electoral General (General Electoral Regime), is not achieved are not to be considered for this purpose.
Three. The grants as referred to in the preceding paragraphs are incompatible with any other type of economic or financial aid included in the Presupuestos Generales del Estado (State Budget), except in the case of the types of aid listed in sub-paragraphs a) and b) of paragraph 1 of article two of the present Law.
