A person who:
1) spends a political party's funds to finance election campaigns otherwise than through the Election Fund,
2) fails to fulfil or prevents the fulfilment of the obligation to prepare and submit the report referred to in Article 38 or provides untrue data therein, shall be subject to a fine, a penalty of restriction of liberty or imprisonment of a maximum of 2 years.
