Title Article 31c Illegally Obtained or Unpublished Donations

Article

31c

(1) A party which has accepted donations in contravention of Article 25 (2) and not forwarded them to the President of the German Bundestag in accordance with Article 25 (4) shall be liable to pay three times the amount equivalent to the illegally obtained amount of money; donations already surrendered shall be taken into account. A party which fails to
publicize donations in its statement of account in accordance with the provisions of this Law (Article 25 (3)) shall be liable to pay twice the amount equivalent to the amount of money not publicized in accordance with the provisions of this Law. The President shall determine the party's liability to pay the amount by an administrative act. Article 31a, paragraphs (2) to (5), shall apply mutatis mutandis.
(2) In agreement with the Presidium of the German Bundestag, the President of the German Bundestag shall, at the beginning of the next calendar year, transfer the funds received within a calendar year to institutions serving charitable, church, religious or scientific purposes.
