9

(1) For the control and promulgation of the costs on the pre-election campaign in accordance with the provisions of this federal law a commission for control of the expenses on the pre-election campaign (hereinafter, "the Commission") shall be formed at the Federal Ministry of Interior. It shall be formed within eight days at the latest after the promulgation of the Ordinance on Scheduling the Elections for National Council in 1975, and in the following eight days its foundation meeting shall be summoned.
(2) The commission members shall be appointed by the Federal Government in accordance with the following provisions:
a) seven members are appointed while taking into account the proposals presented by the political parties represented at the Central Commission of the National Council in compliance with the distribution of forces, provided however that each political party represented at the Central Commission of the National Council must be presented in the commission by at least one member;
b) when a political party as per letter "a" has the right to propose more than one member in the commission, as at least one of the members proposed by that political party must originate from the judiciary profession;
c) all members under letter "a" and "b" propose by mutual agreement three additional members of the expert team in the advertizing industry;
d) if no agreement can be arrived at as regards the proposal under letter "c", a list with persons in the advertizing industry is to be compiled so as each political party represented in the Central Commission of the National Council may nominate such number of members as same is entitled as per letter "a" to delegate as members in the commission, and then three experts out of the list are chosen by lot.
(3) The Commission is chaired by the Federal Minister of the Interior and by a substitute nominated by the latter, as such representative should not necessarily be a member of the commission; the chairperson is not entitled to vote.
(4) If not provided otherwise herein below, the commission adopts its decisions by ordinary majority of the votes. It has a quorum when at least one half of the members entitled to vote are present.
(5) On its first session the commission adopts the rules on its work based on a draft submitted by the Federal Minister of Interior. The decision thereon is adopted by a majority of two thirds of the votes.
(6) In exercising their functions, all members of the commission are independent and are not bound with any directions and instructions; the position of a member of the commission is honorary but its members are entitled to reimbursement of adequate travel costs and expenses in cash. The decision of the commission is not subject of repealing or amendment following an administrative procedure.
(7) The commission acts till the expiry of the terms under § 10; should an objection be raised as per § 10, the mandate of the commission shall expire on the day in which same has pronounced its definitive decision on such objection.
(8) By a majority of two thirds the commission may decide on appointing and defining assignments for consultative councils. Each similar consultative council must comprise at least one representative of the political parties represented in the commission in accordance with Article 2 letter "a".
