36 (2) The chairman will be the representative sent in first instance by the Land that has been appointed to the chair, for which the mandate shall to be given to the party that has the largest number of seats in the Land parliament or, if several parties have the same number of seats, to the party that gained the highest number of votes in the last Land elections; when the claims of several parties are equal, the issue shall be decided by lot. However, the Land parliament may decide that the chairmanship shall be held by another representative of the Land, whose mandate in the Federal Council lies with that party; in any case, such a decision requires the agreement of the majority of those members of the Land parliament whose mandates belong to that party. |
